Terms of Service

1. Agreement to Terms

By downloading, installing, and using the Krese mobile application and website (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Krese reserves the right to modify these terms at any time. Material changes will be communicated with 30 days' notice. Your continued use of the Service following such modifications constitutes acceptance of the updated terms.

2. Service Description

Krese is a goal tracking and reflection application available for mobile devices and web browsers. The Service is designed to help users set, track, and reflect on personal goals and aspirations.

3. Age and Eligibility

By using Krese, you represent and warrant that:

• You are at least 18 years old
• You have the legal right to enter into this agreement
• You are not located in a country subject to trade embargoes
• You are not on any government prohibited persons list

4. Account Registration and Responsibility

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, complete, and current information
• Maintain the confidentiality of your account credentials
• Assume all responsibility for activities under your account
• Notify us immediately of unauthorized account access
• Not share your account with others

5. User Content and Rights

You retain all rights to content you create within Krese (goals, reflections, notes, etc.). By using the Service, you grant Krese a limited license to:

• Store and process your content on our servers
• Display your content back to you in the Service
• Use anonymized, aggregated data for analytics and service improvement

Krese will not share, sell, or publicly display your personal content without your consent.

6. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Post harassing, abusive, or defamatory content
• Attempt to gain unauthorized access to the Service
• Interfere with the operation or security of the Service
• Upload malware, viruses, or harmful code
• Impersonate others or misrepresent your identity
• Engage in spam or commercial solicitation

7. Third-Party Links and Services

Krese may contain links to third-party websites, applications, and services. We are not responsible for:

• The availability or accuracy of third-party content
• The practices or policies of third-party providers
• Your interactions with external services
• Loss or damage resulting from third-party services

Your use of third-party services is subject to their terms and policies. Krese does not endorse or assume responsibility for any third-party services.

8. Intellectual Property Rights

The Service, including its design, features, functionality, and content (excluding user-generated content), is owned by Krese or its licensors. You are granted a limited, non-exclusive license to use the Service for personal, non-commercial purposes.

You may not reproduce, modify, distribute, or exploit any part of the Service without explicit written permission.

9. Limitation of Liability

Our total liability to you shall not exceed the amount you have paid to Krese in the past 12 months, or $100 USD if you have made no payments.

10. Service Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

Krese makes no warranties, express or implied, regarding:

• The accuracy or completeness of content
• The reliability or availability of the Service
• Freedom from errors or interruptions
• Fitness for a particular purpose
• Non-infringement of third-party rights

11. Termination of Service

Krese may terminate or suspend your access immediately, without notice or liability, for:

• Violation of these Terms of Service
• Unauthorized or suspicious account activity
• Violation of applicable laws
• Any reason deemed necessary in our sole discretion

Upon termination, your right to use the Service immediately ceases. We may delete your account data in accordance with our Data Retention Policy.

12. Indemnification

You agree to indemnify and hold harmless Krese, its founders, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these terms
• Your content or actions
• Your infringement of third-party rights

13. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

You agree that any legal action or proceeding arising under these terms shall be brought exclusively in the courts of the Netherlands.

14. Dispute Resolution

Before initiating legal proceedings, you agree to attempt informal resolution by contacting Krese. We will work with you in good faith to resolve disputes.

15. European Union Consumer Rights

If you are a consumer in the European Union, you retain all mandatory consumer law protections, including rights regarding cancellation, refunds, and warranties, regardless of these terms.

16. United States Compliance

The Service is controlled from the Netherlands. If you are located in the United States or elsewhere, you are responsible for compliance with all applicable local laws. The Service may not be available in your jurisdiction.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Krese regarding the Service. Any prior agreements or understandings are superseded.
